Bylaws of the Lincoln County Local Emergency Planning Committee
ARTICLE I. Mission
Section 1: The mission of the LEPC shall be to fulfill the requirements of the Superfund Amendments and Reauthorization Act of 1986 (SARA Title III), and to meet requirements for county departments or planning partners maintaining an emergency preparedness planning committee.
ARTICLE II. Organization
Section 1: The official name of the committee shall be: Lincoln County Emergency Planning Committee

Section 4: Standing Subcommittees include, but are not limited to:
- Chemical Issues
- Volunteer Issues
- Public Health Issues
- Communication Issues
- Training
Section 5: Accurate minutes of all LEPC meetings shall be kept in a dedicated journal, including votes, attendance, and discussion summaries.
ARTICLE III. Officers
Section 1: Officers shall include a Chair, Vice Chair, and Secretary.
Section 2: The Chair presides over all meetings, maintains order, and signs official documents unless delegated to the Vice Chair.
Section 3: The Vice Chair assumes the Chair’s duties in their absence or incapacity and ensures all LEPC information is stored at the official address.
Section 4: The Secretary maintains the official Journal, records accurate minutes, and distributes them per Article II, Section 5.
Section 5: Officers are elected at the final meeting of the fiscal year. Duties begin January 1 and continue for one year.
ARTICLE IV. Membership
Section 1: Members are appointed per SARA Title III, Section 301(c), representing groups such as:
- Federal, state, and local officials
- Fire Departments
- Law Enforcement
- Health and Medical Agencies
- Emergency Management
- News Media
- Local Businesses and Industry
- Facilities with reportable quantities of extremely hazardous materials
Section 2: Members must actively participate. Failure to attend one meeting per year results in removal. Officers missing over 50% of meetings are replaced at the next election.
Section 3: The Lincoln County Emergency Manager serves as Coordinator of Information.
Section 4: Membership applications may be submitted anytime for LEPC approval and appointment by the County Commission and CEPR.
Sections 5–11: Cover subcommittee assignments, alternates, vacancy procedures, annual membership reporting, and withdrawal processes per standard LEPC protocol.
ARTICLE V. Meetings
Section 1: LEPC shall meet at least four (4) times per year.
Section 2: Meetings are held at pre-designated locations/times, with seven (7) days’ notice.
Section 3: Subcommittees may meet independently.
Section 4: A simple majority constitutes a quorum.
Section 5: Order of business:
- Roll call
- Approval of previous minutes
- Agency reports
- Subcommittee reports
- Old business
- New business
- Public forum
- Adjournment
ARTICLE VI. Subcommittees
Section 1: The Chair may appoint subcommittees as needed to meet SARA Title III requirements.
ARTICLE VII. Amendments
Section 1: Members must be notified fifteen (15) days prior to any vote on bylaw amendments. Approval requires a majority vote of members present.
ARTICLE VIII. Voting
Section 1: LEPC decisions are determined by simple majority. Votes may be by voice, show of hands, or roll call, with roll call results recorded in the minutes.
